These Terms of Service apply when you use oviex.in or work with Oviex ("we", "us"). Oviex is a business automation consulting agency: we advise on, design, build and support automations for businesses.
By using this website or engaging our services, you agree to these terms. If you do not agree, please do not use the website or our services.
Our services
Our services include discovery and consulting, the design and build of automations on your tools, testing, handover and ongoing support.
The scope, deliverables, timeline and fees of each engagement are set out in a written proposal or statement of work that we agree with you. If that document and these terms differ, the agreed document applies for that engagement.
Your responsibilities
To deliver the work, we need timely access to the relevant tools and accounts, accurate information about how your processes work, and your feedback and approvals at each stage.
You remain responsible for your own subscriptions to third-party tools and for complying with their terms, and for having the right to use any data we process on your behalf, including any consents required by law.
Third-party tools
Our automations run on tools you choose, such as WhatsApp, Slack, Jira, Tally, Zoho or Google Workspace. We are not responsible for outages, changes, price changes or the discontinuation of third-party tools. Work needed to adapt an automation to such changes may be covered by a care plan or quoted separately.
Fees and payment
Prices shown on this website are starting points ("from"). Your final price is confirmed in your proposal after a discovery call.
Setup fees and care plan fees are invoiced as set out in your proposal. Applicable taxes are added where required. We may pause work if invoices remain unpaid after their due date.
Support after go-live
Every build includes 60 days of free bug-fix support after go-live. This covers defects in what we built. It does not cover new features, changes to your process, or changes made by third-party tools.
Ongoing monitoring, changes and support are available through a monthly care plan.
Ownership
Once you have paid in full, the automations we configure in your accounts are yours to use and change. We keep ownership of our pre-existing know-how, methods, templates and tools, and may reuse general knowledge gained in our work, without using your confidential information.
Confidentiality and data
We keep your business information confidential and use it only to deliver our services. We access your data only as needed for the work, and we handle personal data as described in our privacy policy. A data processing agreement is available on request.
Using this website
You agree not to use this website for any unlawful purpose, to send harmful content, or to attempt to gain unauthorised access to our systems. Content on this website, including text, graphics and logos, belongs to Oviex unless stated otherwise.
Limitation of liability
Oviex is not liable for any indirect, incidental, special or consequential loss, including loss of profit or data, arising from the website or our services. Our total liability for any claim is limited to the fees you paid us for the service concerned in the three months before the claim.
Ending an engagement
Either party may end an engagement as set out in the proposal. Fees for work completed up to that point remain payable, and we will hand over what has been built for which you have paid.
Governing law
These terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in India.
Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Signed proposals keep the terms that applied when they were agreed, unless both parties agree otherwise.
